(h) obtain prescription medications (“Prescription Medications”) prescribed by independent licensed healthcare providers offering telemedicine consultations (“Telemedicine Services”); and/or
(i) contact us or request a call through forms or contact details provided on the Site (“Contact Services”).
Together, these services and features are referred to as the “Site Offerings.”

HIPAA and Protected Health Information (PHI)
When you create an account with AlphaU, you establish a customer relationship that allows you to use our Website and its Offerings. As part of that relationship, you may provide your name, email address, address, and phone number. This data is not considered “protected health information” (PHI) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
However, when you request Prescription Medications or certain Nonprescription Products, you may provide medical details that could fall under HIPAA protections. While AlphaU itself is not a “covered entity” under HIPAA, the independent healthcare providers we work with are. In some cases, AlphaU may operate as a “business associate” to these providers, which means that we may be required to comply with certain HIPAA obligations when handling PHI.
Any medical or health data you provide that is subject to state or federal health privacy laws (collectively, “Protected Information”) will be handled in accordance with those laws. Information that is not classified as Protected Information under applicable regulations may be processed according to this Privacy Policy.
Independent Healthcare Providers have their own Notices of Privacy Practices that describe how they handle PHI. By using the Site or any of its Offerings, you acknowledge that you have read and accepted those Notices.

AlphaU collects and retains various types of information when you use our Services. The data collected depends on how you interact with our platform and which Services you use. This information may include both personal and health-related data.

This may include identifiers such as your name, date of birth, gender, physical address, email, phone number, or identification numbers; electronic data such as photos or videos provided for non-medical purposes; commercial information like purchase and payment history, order details, and shipping records; internet or network activity data such as IP address, geolocation, device type, log files, and cookies; and inferences drawn from the information collected, including your preferences, habits, or characteristics.
Health information is a specific category of personal information that relates to your medical background and is used for diagnostic or treatment purposes. This may include medical history, symptoms, conditions, medications, allergies, treatment options, prescriptions, and other health-related details; photos or videos provided for diagnosis or treatment; and commercial data related to your order or shipment of medical products.
Our Services are not intended for individuals under 18 years of age. By using AlphaU’s Services, you consent to verification of your identity and age through our third-party identification provider. AlphaU does not knowingly collect personal or health information from minors. If you are a parent or guardian and believe that your child under 18 has provided such information to AlphaU without your consent, please contact us at support@alphau.com.
2. USE OF YOUR INFORMATION
AlphaU and its service providers use your information for various purposes related to providing and improving our Services. Before you begin the application process, you authorize AlphaU to verify your identity through third-party vendors to confirm that you are the legitimate account holder. This verification step occurs before account creation.
Your information may be used to provide telehealth and related services, manage your account, process payments, troubleshoot technical issues, and deliver customer support. We may also use it to communicate with you about the Services, send administrative notices, or inform you about updates. Additionally, we may use your information to operate promotional programs such as sweepstakes or contests, to market AlphaU’s own products and third-party services that may interest you, to personalize the user experience and improve service functionality, and to conduct product research and development. Your information may further be used to detect, investigate, and prevent fraud, abuse, security incidents, or illegal activity; to enforce our Terms of Service and other policies; and to comply with applicable laws and regulations.
AlphaU may send marketing emails or text messages about new products, services, and updates. You can opt out of marketing emails at any time by clicking the “unsubscribe” link in any promotional message or by contacting support@alphau.com. Please note that you cannot opt out of transactional communications, such as account-related notices, password changes, service confirmations, or messages from your healthcare provider. To stop receiving text messages of any kind (including operational, promotional, or transactional), you can reply with the word “STOP” from the mobile device receiving them.
AlphaU uses analytics tools, including Google Analytics, provided by Google LLC, to collect data on how users interact with the Website. This technology uses cookies and similar tracking mechanisms to help us understand usage patterns, improve performance, and display content or advertisements that may be relevant to your interests. To prevent your data from being used by Google Analytics, you can install the Google Analytics Opt-out Browser Add-on.
Some web browsers offer a “Do Not Track” (DNT) feature that signals websites not to monitor online activity. At this time, AlphaU does not respond to DNT signals or similar browser-based mechanisms.
3. SHARING OF INFORMATION
We understand the importance of protecting the confidentiality of your information and disclosing personal and health data only when necessary and in accordance with this Privacy Policy. We may share your information with licensed healthcare providers (including those offering medical services, medications, or devices) to enable them to deliver telehealth and related services you request. We may also disclose information to a parent, subsidiary, or affiliate of our company; trusted third-party service providers who assist in operating our business, such as IT service providers, data storage and hosting companies, ad networks, analytics providers, marketing and advertising partners, payment processors, professional advisors, and maintenance or technical support entities.
We may share information with our employees, contractors, business partners, and agents who help deliver our products and services; sponsors or promoters of any contests or promotions we organize; credit reporting agencies, courts, tribunals, or regulatory authorities in the event of non-payment; and law enforcement or other government bodies as required by applicable law or legal process. We may also disclose information as necessary to investigate, detect, prevent, or respond to fraud, abuse, security threats, or other unlawful activity, and to establish, exercise, or defend our legal rights.

Please note that text messaging originator opt-in data and consent will not be shared with any third parties.
Third-party services we currently use include: Google Analytics, Mixpanel, Klaviyo, Google AdSense, Bing Ads, Facebook Ads, Reddit Ads, Pinterest Ads, Friendbuy, and Rakuten.
The personal information we collect may be stored and processed in the United States or in other jurisdictions where we, our affiliates, partners, or service providers operate. These countries may have data protection laws that differ from those in your country of residence. When transferring your information internationally, we ensure that such transfers comply with applicable laws and that your personal information remains protected in accordance with this Privacy Policy.

AlphaU takes extensive precautions to safeguard your personal information, both online and offline. Access to your personal information is strictly controlled and limited to authorized personnel who require it to perform specific business functions. We maintain reasonable physical, electronic, and administrative safeguards to prevent unauthorized access, use, or disclosure of your information. All personal data is stored in secure environments, both within AlphaU offices and at facilities operated by approved third-party service providers. Confidentiality obligations bind employees and agents with access to personal information and are subject to disciplinary measures for any breach of our data protection policies.
You are also responsible for maintaining the confidentiality of your account credentials and password. If you detect any suspicious activity or suspect that your account has been compromised, please notify us immediately at support@alphau.com.
Our servers are housed in physically secure facilities, and multiple layers of security controls are implemented to protect your data against loss, misuse, unauthorized access, or alteration. Despite these efforts, no storage system, software, or data transmission over the Internet or wireless networks can be guaranteed to be completely secure. While AlphaU employs advanced technologies to minimize risk, unauthorized access, hacking, or technical errors could compromise certain portions of your personal information. Any unauthorized attempt to access or damage our systems, databases, or servers is strictly prohibited and may be subject to criminal prosecution under applicable law.

5. SMS POLICY
Use of our text message–based communications (“SMS Services”) is subject to the following terms. AlphaU uses SMS to deliver product updates, reminders, and notifications, including requests for additional information about your account or orders. Message delivery depends on your wireless carrier’s network, and neither AlphaU nor your carrier is responsible for delayed or undelivered messages. Standard message and data rates may apply depending on your mobile service plan.

You may opt out of receiving SMS messages at any time by replying STOP to any message. Text alerts are typically sent at most one message per day, though frequency may vary depending on your interactions with the Services.
AlphaU will not share, rent, or sell your personal information to other companies or individuals without your explicit consent. No mobile information, including text message originator opt-in data or consent, will be shared with third parties or affiliates for marketing or promotional purposes. AlphaU account-related updates may include up to one message per day. Reply STOP to opt out or HELP for assistance. Message and data rates may apply.
6. RETENTION OF INFORMATION
AlphaU retains personal and health information for as long as necessary to fulfill the purposes outlined in this Privacy Policy and as required or permitted by applicable laws and regulations. In some jurisdictions, you may have the right to request the deletion of your personal information; however, certain records, particularly those containing health or medical data, must be preserved in accordance with legal and regulatory requirements.
AlphaU maintains medical records for a minimum period of five (5) years, or longer if mandated by state or federal law, after which they may be securely destroyed. Suppose you are under the age of twenty-three (23) at the time your records would otherwise be eligible for destruction. In that case, those records will be retained at least until you reach the age of 23, or for any more extended period required by applicable law.

Please note that deleting your personal information may restrict your ability to access certain Website Offerings. If you wish to maintain full access to all services, some personal information may need to remain on file. Additionally, residual copies of your information may remain in our backup systems for a time before being entirely deleted from active servers.

AlphaU may update this Privacy Policy from time to time to reflect changes in our business practices, operational processes, or to comply with new legal or regulatory requirements.
